NSEA Announces Ruling Reinstating Teachers

Nevada State Education Association successful in lawsuit resulting in back pay and benefits
Published: October 2, 2018

Las Vegas, NV –The Nevada State Education Association is very pleased to announce a victory on behalf of CCSD teachers who were, according to the judge’s ruling in the case, “deprived...of due process...”

“This win for members emphasizes the benefit of belonging to a union that’s backed by NSEA. When CCEA was unsuccessful, NSEA continued the fight with the resources to set things right. Support and resources are just two of the reasons NEA-SN formed, to continue to serve members at all levels,” said Chet Miller, NEA-SN President.

“The Nevada State Education Association will always stand up for the rights of all educators in Nevada. Licensed and Education Support Professionals rely on their membership at the local, state, and national level to strengthen their profession,” said Ruben Murillo, Jr., NSEA President.

Fifteen teachers who were on post-probationary status were placed back on probation and subsequently terminated. CCEA was unsuccessful at the local level and referred the case to NSEA for action. Following the unsuccessful attempt by CCEA to see these teachers reinstated, NSEA filed a Federal lawsuit and was able to win a judgment that has the teachers reinstated to a post-probationary status with back pay and benefits. The judge, in this case, declared the District “deprived Plaintiffs of due process when it divested them of their post-probationary status without notice or a meaningful chance to be heard.”
